Request for Refund of Unjust Annual Credit Card Fees by Yapi Kredi Bank

I request the cancellation and refund of the total 356.00 TL annual card fees charged to my Yapı Kredi credit card, ending with the digits 2261. Pursuant to Article 31, Paragraph 3 of the Consumer Law No. 6502 dated May 28, 2014, institutions issuing cards are obliged to provide consumers with a credit card type that does not charge annual membership fees or similar fees under various names. Furthermore, in accordance with Article 6 of Law No. 4822 amending Law No. 4077 on the Protection of the Consumer, your bank's membership fee is considered an unfair term since it does not correspond to any service provided. This contractual term is considered unfair as it is pre-drafted, cannot be negotiated, and is included in standard contracts, rendering its content non-negotiable and unfair. Referring to the final decision in case number 2011/4736 and decision number 2011/11579 by the 13th Civil Chamber of the Court of Cassation, there is a definitive ruling stating that the annual card fee will be refunded, and retroactively, card fees deducted will also be refunded, in accordance with Article 125 of the Turkish Code of Obligations and the decision of the General Assembly of Law No. 2010/1-93-88. I kindly request the necessary actions be taken for the refund of the 356.00 TL membership fee, as it is unjustly collected. Failing to do so, I will reserve my legal rights and proceed to file a complaint with the Consumer Arbitration Board. Additionally, if a resolution is not achieved, I will proceed with the cancellation of my card.
