My Credit Card Was Charged Without Consent by Akbank - I Want a Full Refund
On March 23, 2025, a membership fee of ₺909.50 was charged to my credit card ending in 4077. I request a full refund of this fee. In accordance with the relevant provisions of the Consumer Protection Law, I demand the cancellation and refund of the membership fee without any conditions. As stated in Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, credit card issuers are obligated to offer a type of credit card that does not incur an annual fee or similar charges. Furthermore, under Article 6 of Law No. 4077, as amended by Law No. 4822, the membership fee imposed by your bank constitutes an unfair term in the contract, as it is pre-drafted and not subject to negotiation. According to the final decision of the 13th Civil Chamber (2011/4736 E., 2011/11579 K.), and in line with Article 125 of the Code of Obligations and decision HGK 2010/1-93-88, there is also a definitive ruling that past fees must be refunded retroactively. I therefore request the cancellation of this fee and the refund of the ₺909.50 charged.
