Demanding Refund of Unauthorized VakıfBank Credit Card Annual Fee

On June 16, 2024, an amount of 569 TL was charged to my VakıfBank credit card under the guise of an annual card fee. As per Law No. 6697, I demand an unconditional refund of this fee. According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, card issuers are obliged to offer a credit card type that does not charge an annual membership fee or similar charges. Pursuant to Article 6 of Law No. 4077, as amended by Law No. 4822, concerning unfair terms in contracts related to consumer protection, your bank's collection of membership fees constitutes an unfair term since it does not correspond to any service provided, and such terms are predetermined and non-negotiable in standard contracts. According to the definitive decision of the 13th Civil Chamber dated 2011/4736 and numbered 2011/11579, the annual card fee must be refunded, and retroactively levied card fees must also be refunded in accordance with Article 125 of the Turkish Civil Code and the General Assembly of Civil Law's decision numbered 2010/1-93-88. I request the refund of all collected credit card fees and replacement with a fee-free card. I expect prompt action and a response. Otherwise, I will cancel my card and seek recourse through the Banking Association and the Consumer Arbitration Board.
