Pull & Bear Refuses an Exchange Over a Tag That Was Missing at Purchase

I'm experiencing a serious issue with a t-shirt I purchased from the Pull & Bear store at Maltepe Piazza AVM on 06/27/2026.
Shortly after buying the product, I noticed a clear tear/defect at the back of the neck area, which I believe stems from a manufacturing fault. I then went to the store requesting an exchange. However, I was told that the transaction couldn't be processed because the inner waistband tag was missing.
The product was sold to me this way from the very first purchase, already missing its inner tag; I did not remove the tag myself. The product is very new, and I have all my purchase records, including the receipt, complete and intact. There has been no alteration of any kind made to the product by me.
The defect at the neck area and the missing inner tag are both clearly visible in the photos I have. Despite this, having the burden of a defective product sale and a missing tag placed on me as a consumer is not something I can accept.
Under Turkish Consumer Protection Law No. 6502, consumers have the right to exchange or return defective products. After the sale of a product with a missing tag and a manufacturing defect, placing the responsibility on the consumer is neither legally nor ethically correct.
For this reason, I am requesting that this product — for which I can provide images clearly demonstrating the defect — first and foremost be exchanged, or, if that isn't possible, that an appropriate solution be provided.
Otherwise, please be advised that I will submit formal applications, along with all my documents and images, to the relevant authorities, including this complaint platform and the Consumer Arbitration Committee.
