My HSBC Credit Card Charged Annual Fee Despite Minimal Use
I've been a long-time customer of your bank. In December 2023, you sent me an SMS stating that my card would be canceled at year-end if I didn't make any purchases. I made a small purchase of ₺29.16 and paid it off. Months later, on July 15, 2024, my HSBC credit card ending in 8922 was charged an annual membership fee of ₺790. I request this fee be canceled without any additional conditions, based on the following legal provisions:
According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, card-issuing institutions must offer a credit card type without annual membership fees.
As per Article 6 of the Consumer Protection Law No. 4077, amended by Law No. 4822, this membership fee is an unfair contract term as it doesn't correspond to any service and wasn't negotiable in the standard contract.
The 13th Civil Chamber's decision (2011/4736 basis, 2011/11579 numbered) states that such annual card fees should be refunded, even retroactively, in accordance with Article 125 of the Code of Obligations and the decision of the General Assembly of Civil Chambers (2010/1-93-88).
I request the refund of this fee. If not addressed, I will pursue legal action and cancel all my accounts and credit cards with your bank.
