Garanti BBVA Charged Annual Fee to My Bonus Trink Card and I Want a Refund
On August 31, 2024, an annual card fee of ₺583.00 was charged to my Garanti Bonus Trink credit card ending in 3030. I request the cancellation and refund of this fee, based on the legal provisions mentioned below and without any additional conditions.
Consumer Law, May 28, 2014, Article 31, Paragraph 3: Card-issuing institutions are required to offer a type of credit card to consumers that does not involve an annual membership fee or similar charges.
According to Article 6 of the Law on the Protection of Consumers No. 4077, as amended by Law No. 4822, regarding unfair terms in contracts: The membership fee charged by your bank constitutes an unfair term since it is not provided in exchange for any service, and because the contract clause in question was pre-prepared and placed in a standard contract, making it non-negotiable.
According to the most recent decision of the 13th Civil Chamber, case number 2011/4736, decision number 2011/11579: There is a definitive ruling that the aforementioned annual card fee must be refunded retroactively, under Article 125 of the Code of Obligations and HGK decision number 2010/1-93-88.
I request that the necessary steps be taken to refund the fees charged to me. Otherwise, I will pursue legal action and cancel my credit card with your bank.
