Request for Refund of Annual Membership Fees On İş Bankası Maximum Card

On January 10, 2024, an annual membership fee totaling ₺553.88 was charged to my İş Bankası Maximum card ending in 1323, consisting of ₺527.50 and ₺26.38. I request the unconditional cancellation and refund of this fee, based on the following legal provisions: The Consumer Protection Law (Law No. 6502, Article 31, Paragraph 3, dated May 28, 2014) obligates credit card issuers to provide an option without annual membership fees or similar charges. Furthermore, the Consumer Protection Law, as amended by Law No. 4822 (Article 6 – Unfair Terms in Contracts), establishes that annual membership fees are an unfair contractual term as they do not correspond to any actual service provided. These terms are pre-drafted and non-negotiable, making them unfair under the law. Additionally, the rulings of the 13th Civil Chamber of the Supreme Court (Case No. 2011/4736, Decision No. 2011/11579) confirm that annual membership fees can be reclaimed retroactively under Article 125 of the Code of Obligations. Moreover, an additional charge of ₺383.65, consisting of ₺365.38 and ₺18.27, applied on January 10, 2024, has not yet been refunded. I kindly request the reimbursement of both these charges and all previously deducted annual membership fees. Please notify me once the process is completed. Since the bank did not respond, I am taking my complaint to the Consumer Arbitration Committee. I will keep you informed of developments.

On January 14, a defense was requested from the company, and even though more than a week has passed, they have not even responded to this. The level of indifference is this great.

According to the response from the consumer arbitration committee, the bank has requested the rejection of the application, and the committee has made a decision based on the bank's request and rejected my application. Now, in this situation, I declare and inform here that I will cancel all bill payments, accounts, and cards with İş Bankası as soon as possible and express my reaction by not reopening my connection with them. I will continue to keep you informed of developments.
