Garanti BBVA Gold Credit Card Annual Fee Dispute

On April 12, 2024, an annual card fee of ₺678.50 was charged to my Garanti Bonus Money credit card, ending in 3036. I demand the cancellation of the annual card fee in accordance with the provisions of the law and without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law No. 6502 dated May 28, 2014, issuing institutions of cards are obliged to offer consumers a type of credit card that does not charge an annual membership fee or similar fees. Additionally, under Article 6 of Law No. 4077 on the Protection of Consumers, amended by Law No. 4822, the membership fee charged by your bank is considered an unfair term in the contract, as it does not correspond to any service provided. As per the decision of the 13th Civil Division with the reference numbers 2011/4736 and 2011/11579, there is a definitive ruling that the annual card fee will be refunded, including retroactively levied card fees according to Article 125 of the Turkish Civil Code and the decision of the General Assembly of Law No. 2010/1-93-88. I request the refund of the annual card fees charged to me. Otherwise, I will resort to legal action and declare that I will cancel all my accounts and credit cards with your bank.
