Yapi Kredi Bank Unauthorized Annual Fee Charge
On 29/10/2023, an annual credit card fee was deducted from my World Platinum card ending in 1261. As a salaried customer of your bank, the fee reflected in the account statement under the guise of a card fee must be canceled and refunded to me without any additional conditions, under the laws mentioned below. According to Consumer Law Article 31, issued on May 28, 2014, banks issuing cards must provide a credit card type that does not charge annual membership fees or similar fees. Furthermore, based on Article 6 of Law No. 4077, which was amended by Law No. 4822, concerning unfair terms in contracts regarding consumer protection, your bank's membership fee is considered an unfair term as it is not in exchange for any service and is not negotiable due to its inclusion in the standard agreement without prior discussion or impact on its content. Additionally, according to the final decision in Case 2011/4736 - 2011/11579 by the Judiciary Administration and ruling HGK 2010/1-93-88, it is decreed that the previous card fees charged retrospectively will be refunded according to Civil Code Article 125. As per these laws, I demand a refund of the credit card membership fee and request to be informed via email or SMS on this matter. If not complied with, I will initiate legal action, resorting to legal procedures and the Consumer Arbitration Board, submitting an application to cancel my Yapı Kredi Bank credit card.
I am a salary customer of Yapı Kredi Bank and they have charged an annual card fee of 456.50 TL for the credit card they sent me, even though I did not request it because there was no annual fee. And I have still not received any response from the bank regarding this issue.
