My ticket number 235216040**9 for the Istanbul-Lviv flight was canceled by Turkish Airlines due to the flight not being able to take place, without my consent. I was informed via their website and customer service that I could use the ticket as an open ticket for one year and get a refund within two years. However, Turkish Airlines has failed to refund my ticket, claiming that the usage period has expired. This is clearly unlawful. Below, I list the ticket rules. They are not even adhering to their own regulations. According to the General Conditions of Carriage for Passengers and Baggage, Article 3.2.1.1 (c), if a scheduled flight does not take place, the validity period of the passenger ticket is extended until the first flight of the carrier in the same class of service for which the fare has been paid. (Lviv flights have not yet resumed.) Additionally, Article 10.2.2 of the Regulation on the Rights of Passengers Traveling by Air (SHY-YOLCU) states that if the planned journey no longer has any meaning for the passenger, a full refund of the ticket is provided. Article 11.1 states that if the carriage is not provided by the carrier in accordance with the contract of carriage, or if a change is made at the passenger's request, a refund is made for the unused ticket or part thereof in accordance with the carrier's rules and this article. Article 11.3 states that if the carrier cancels a flight, cannot perform a flight according to the schedule, cannot stop at a stopover point that is a part of the passenger's ticket or planned stopover, cannot provide a confirmed seat, or cannot connect the passenger to a connecting flight, the refund amount will be equal to the fare paid for the unused portion of the ticket. Moreover, as can be seen from the link provided on https://www.turkishairlines.com/tr-int/bilgi-edin/acik-tarihli-ic-hat-dis-hat-biletimin-son-iade-tarihini-ogrenebilir-miyim/, the usage period for open-dated tickets is specified as two years. In accordance with the information provided to me about the right to change within one year and refund within two years, I kindly request a refund of ₺507.33 for my ticket and the miles I used.
