As a result of a traffic accident in which the opposing party was found to be 100% at fault, a claim file numbered 20260003810-01 was opened with HDI Insurance Inc., the traffic insurer of the opposing party.

During inspections carried out by different repair services for the same damage, one repair shop stated that the vehicle could be repaired for approximately $5,520 USD, while another authorized service stated that the repair could be completed for approximately $3,220 USD. Despite the fact that the vehicle is clearly repairable at a reasonable cost, HDI Insurance attempted to declare the vehicle a total loss without properly evaluating the repair option or taking the lower repair estimate into consideration. Furthermore, the vehicle was put up for auction without my knowledge or consent.

Documents implying consent to a total loss—such as a vehicle deregistration document, a total loss power of attorney, and a settlement and indemnity receipt—were sent to me. However, despite notifying the company in writing that I do not accept these documents, no corrective action was taken.

In both my written and verbal communications, I clearly rejected the total loss (salvage) process and documents, yet HDI Insurance did not consider or pursue any repair option. Without my consent or approval, they directly listed my vehicle for auction and treated it as a total loss, without any genuine repair assessment or negotiation, even though repair was clearly possible at a significantly lower cost.

Due to the prolonged failure to finalize the claim file, I have been left without a vehicle for weeks. This has caused serious inconvenience and financial hardship, including additional expenses that I had to cover personally during this period.

While the opposing party is fully at fault and the vehicle is clearly repairable at a reasonable cost, HDI Insurance’s approach is unjust, arbitrary, and has caused significant harm. I request that the decision to declare my vehicle a total loss be withdrawn, that the claim file be finalized through repair, and that all my damages and grievances be fully remedied as soon as possible.
