Turkish Airlines QNB Finansbank Miles&Smiles Credit Card Annual Fee Issue
In January 2024, an annual membership fee of ₺712.00 was charged to my Miles&Smiles credit card ending in 3080. When I obtained the credit card, it was stated that there would be no annual fee or dues. I request the cancellation of the fee according to the legal provisions mentioned below, without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law No. 6502 dated May 28, 2014, card issuers are required to offer a type of credit card that does not charge an annual membership fee or similar fees to consumers. According to Article 6 of the Law on the Protection of Consumers No. 4077, as amended by Law No. 4822, the membership fee charged by your bank is an unfair term as it is not in exchange for any service, and since it is a pre-prepared term in a standard contract, it cannot be negotiated or influenced. According to the final decision of the 13th Civil Chamber of the Court of Cassation, Case No. 2011/4736 and Decision No. 2011/11579, it is definitively ruled that the annual card fees charged retroactively must also be refunded according to Article 125 of the Code of Obligations and the decision of the General Assembly of the Court of Cassation No. 2010/1-93-88. I request the necessary actions to be taken for the refund of the annual membership fee of ₺712.00, the cancellation of the membership fee within the day, and its refund to me.
