Turkish Airlines Miles&Smiles Credit Card Annual Fee Issue

On 09.03.2024, an annual card fee of ₺1,426 was charged to my 'Miles&Smiles' credit card ending in 2018. I request the refund of this baseless and excessive card fee for my active credit card by the legal provisions specified below, without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law No. 6502 dated May 28, 2014, card-issuing institutions are required to offer a type of credit card to consumers that does not charge an annual membership fee or similar charges. Under Article 6 of the Law on the Protection of Consumers No. 4077, as amended by Law No. 4822, the membership fee charged by your bank is unjust as it is not in exchange for any service. This contract term is considered unfair since it was pre-prepared and included in a standard contract, making it non-negotiable. According to the final decision of the 13th Civil Chamber, case number 2011/4736, decision number 2011/11579, the annual card fee must be refunded retroactively as per Article 125 of the Code of Obligations and the General Assembly of the Supreme Court's decision number 2010/1-93-88. I request that the necessary actions be taken to refund the charged fees. Otherwise, I will take legal action and cancel all my accounts and credit cards with your bank.
