I am the owner of the brand İda Herbals. In August, my product “Nioli Essential Oil,” which I listed for sale on Trendyol, was unfairly removed from sale due to an alleged trademark certificate discrepancy. At Trendyol’s request, I submitted the official and final authorized reseller certificate issued in my company’s name, complete with the brand owner’s signature and stamp. However, my product still hasn’t been reinstated. Trendyol claims the listing was blocked because of the term “Nioli” and that a court warning had been issued. Yet, “Nioli” (Melaleuca quinquenervia) is a plant name—just like “Lavender” or “Orange”—not a trademark, and it is a generic essential oil term. According to the Turkish Patent and Trademark Office, plant and chemical substance names cannot be registered as trademarks (Industrial Property Law No. 6769, Article 5/1-c). Therefore, “Nioli” cannot belong to any single brand and should be free for everyone to use. Moreover, nearly 100 different brands are currently selling products under the name “Nioli Essential Oil” on Trendyol. This situation is not about trademark rights but rather an unfair monopolization of a generic product name. Despite explaining the issue multiple times through the seller panel, Trendyol only replied, “Other products will be removed over time,” which is an inadequate response. This creates unfair competition and prevents the efforts of local, registered brands like mine from being recognized. I request that Trendyol take the necessary action and reinstate my product by recognizing “Nioli Essential Oil” as a generic name. My product code: ıdh1234578.
