Garmin Nuvi 40 Won’t Update Despite “Free Update” Label

I purchased my Garmin Nüvi 40 navigation device on March 7, 2013 from Metro Gross Market in Ankara, with an invoice. Even though the product packaging clearly states that I have a free update entitlement, Garmin technical service informed me that they cannot update the device because it is an older model. If that is the case, then why does the original box say “Free updates”? Doesn’t “free update” mean lifetime free updates?
If the updates were only valid for a limited period, or if they required payment afterward, this should have been clearly stated. I would have made a different purchasing decision. Now I am left with a device that is essentially unusable.
I request that my device be replaced with a functional, up-to-date model as soon as possible.
