Yapi Kredi Bank Annual Credit Card Fee

On February 20, 2023, when I accessed my mobile banking internet branch for my Yapi Kredi Bank credit card ending in 8547, I noticed that an annual card membership fee of 356.00 TL had been deducted from my account transactions. I request the cancellation of this bank fee based on the provisions of the relevant laws and without any additional conditions. According to Consumer Law, Article 31, Paragraph 3, card-issuing institutions are obligated to offer a type of credit card that does not charge an annual membership fee or similar fees. As per Law No. 4822, Amendment of Law No. 4077 on the Protection of Consumers, Article 6, concerning unfair terms in contracts, the membership fee charged by your bank is unjust since it does not correspond to any service provided. Additionally, the fee is considered unjust as it was included in a predetermined standard contract without negotiation, as stated in Article 6. Furthermore, based on the definitive ruling of the 13th Civil Chamber, Decision No. 2011/4736 and 2011/11579, the annual card fee will be refunded in accordance with Article 125 of the Turkish Civil Code and the Supreme Court Decision No. 2010/1-93-88. I request the cancellation of the 356.00 TL fee and the necessary actions to be taken. Otherwise, if this matter is not resolved, I intend to file a lawsuit with the Consumer Court for the refund of all previously charged card fees, in line with the relevant provisions of the laws of the Republic of Turkey. Please be informed that if the card fee continues to be charged despite my objections, I will cancel my card.
