Refund Request for Unauthorized Credit Card Membership Fee by Yapi Kredi Bank
I am writing to request the immediate cancellation and refund of the 356.00 TL annual membership fee charged to my Worldcard credit card by Yapi Kredi Bank on August 27, 2023, in accordance with the legal provisions listed below, without any additional conditions. According to Article 31, paragraph 3 of the Consumer Protection Law, card-issuing institutions are required to offer a type of credit card that does not require an annual membership fee under any name. Furthermore, according to Article 6 of Law No. 4077 on Consumer Protection, as amended by Law No. 4822, your bank's membership fee does not correspond to any service, making it an unfair condition that cannot be negotiated due to its inclusion in the standard contract terms. In accordance with Article 125 of the Turkish Code of Obligations and the High Court of Appeals' decision 2010/1-93-88, the decision of the 13th Civil Chamber (2011/4736 esas 2011/11579) supports the refund of retroactively collected card fees. I demand a prompt refund and cancellation of the 356.00 TL membership fee. If you do not comply, I will take legal action through Consumer Rights and other legal channels available to me.
