Yapi Kredi Bank's Worldcard Annual Fee Battle
I am writing regarding the unjust annual membership fee of 356.00 TL, reflected on my Worldcard credit card ending in 5002, charged by Yapı Kredi Bank on August 20, 2023. According to the relevant legal provisions and without any additional conditions, I am formally requesting the cancellation of this fee and its prompt refund. According to Article 31, paragraph 3 of the Consumer Law, "issuers of cards are required to offer a type of credit card without charging an annual membership fee or any similar charges." Furthermore, under Law No. 4822 amending Consumer Protection Law No. 4077, and Article 6 titled 'Unfair Contractual Terms' therein, the bank's annual membership fee lacks any corresponding service, rendering the clause unfair due to its predetermined, non-negotiable inclusion in standard agreements. Furthermore, there is clear legal precedent for the refund of retroactively charged annual card fees based on the ruling of the 13th Civil Chamber, 2011/4736, and the definitive judgment in accordance with Article 125 of the Turkish Code of Obligations and HGK 2010/1-93-88. I request a full refund of the 404.50 TL membership fee, as well as the immediate cancellation of the fee. If you do not comply, I will seek justice through all available legal channels, including Consumer Rights.
