Diesel Runaway Problem In 5 Months Hyundai Tucson – Exchange Request


I am the owner of a 5-month-old Hyundai Tucson with approximately 5,000 km, and I experienced a serious diesel runaway incident on March 27, 2026. While driving uphill toward İnegöl after passing Bursa Kestel, the vehicle suddenly accelerated uncontrollably and did not respond to my attempts to stop it. The incident lasted about two minutes. During this time, my wife and two children were in the car; we were extremely frightened, and my children were crying and traumatized. This was a life-threatening situation and could have resulted in a fire or a severe accident. Immediately after the incident, I tried to reach the authorized service, but no one answered. I then contacted the sales representative and was told to request a tow truck through my insurance. I had the vehicle towed to the authorized service. The next day, I visited the service, explained everything, and was verbally informed that the issue was not caused by user error. I also contacted Hyundai and reported the incident. Later, I was informed that they could replace the engine and major components. However, after such a serious failure in a nearly new vehicle, I have completely lost trust in its safety. My family and I have been psychologically affected. I clearly stated that I want to exercise my legal right to a one-to-one replacement. Despite this, I was told such replacements are not provided and was discouraged with references to past cases. I have also not been provided with a replacement vehicle and am currently without transportation, which is causing serious disruption. Given the severity of the incident, I do not accept repair or part replacement as a solution. I request a one-to-one replacement with a new Hyundai Tucson and a temporary vehicle until the process is completed. I also request all technical findings be provided in writing and expect a prompt resolution.
I have encountered a serious safety issue with my car; the service only left a comment and sends automatic SMS every day, and my request for a replacement hasn't made any progress yet.
The Bursa Hyundai İnallar service gave me my car with a reconditioned engine after the following parts were replaced. The company and the service did not respond to my official notice regarding the replacement of the defective product. I signed a sealed document accepting their claim and received the car about a week ago. I gave power of attorney to my lawyer and told him to file a loss‑of‑value lawsuit. I will not leave any installation to this company. They replaced this many parts on a 5,000 TL vehicle. Now, after reporting these replaced parts, how much can I sell this car for? Of course, below its value.
