An annual fee of ₺1,800 was charged to my Garanti AMEX Green Card credit card (ending in 020) without my knowledge or consent and reflected on my statement. I request a refund of this amount. I'm also demanding the cancellation of these fees without any additional conditions, based on the following legal provisions:
Consumer Law Article 31, Paragraph 3, dated May 28, 2014, states that card-issuing institutions must offer consumers a type of credit card without annual membership fees or similar charges.
According to Article 6 of the Consumer Protection Law No. 4077, amended by Law No. 4822, regarding Unfair Terms in Contracts, the membership fee your bank charges is unfair as it's not in exchange for any service and is part of a pre-prepared standard contract that can't be negotiated.
The 13th Civil Chamber's final decision (Case No. 2011/4736, Decision No. 2011/11579) ruled that annual card fees should be refunded, including those deducted retroactively, in accordance with Article 125 of the Code of Obligations and the General Assembly of Civil Chambers' decision No. 2010/1-93-88.
Based on these laws and regulations, I request the refund of the charged membership fee, its cancellation within the day, and its return to me. Otherwise, I'll apply to the Consumer Arbitration Committee for a refund of the card fee, and if my dissatisfaction persists, I'll apply to your bank to cancel my card. I respectfully request that necessary action be taken on this matter.
