Garanti Bank American Express Gold Card Unauthorized Annual Fee Charges

On April 20, 2024, the annual membership fee of ₺3,600 was withdrawn from my Garanti Bank American Express Gold card, numbered 3576*******6017. I seek the cancellation of membership costs in accordance with the legal rules listed below, with no further restrictions. According to Article 31, paragraph 3 of the Consumer Law dated May 28, 2014, card issuing banks shall provide consumers with a form of credit card that does not impose yearly membership fees or other costs. According to Article 6 of Law No. 4077 on Consumer Protection, as amended by Law No. 4822, regarding unfair terms in contracts, your bank's membership fee is considered an unfair term because it does not correspond to any service, is pre-prepared, and is non-negotiable due to inclusion in the standard contract. Based on the 13th Civil Division's final decision in cases no. 2011/4736, 2011/11579, and the General Assembly of Civil Chambers' decision numbered 2010/1-93-88, it is clear that retroactively deducted card fees will be refunded in accordance with Article 125 of the Turkish Code of Obligations. As a result, I seek a refund of the membership price obtained in accordance with these rules and regulations, as well as the cancellation and reimbursement of the membership charge within the same day. Otherwise, I will contact the Consumer Arbitration Committee, and if my complaint is not resolved, I will deactivate my card and accounts with your bank. I respectfully request that the necessary action be taken.
