I Demand for Membership Fee Refund for Garanti Bank Credit Card
I request that the membership fee of ₺583.00, which was charged to my Garanti Bank credit card ending in 7052 on 11.06.2024, be canceled and refunded to me immediately, in accordance with the provisions of the law stated below and without any extra conditions.According to the 3rd paragraph of Article 31 of the Consumer Law No. 6502 dated 28 May 2014, card issuers are obligated to offer consumers a type of credit card for which they do not charge annual membership fees or similar fees. Furthermore, in accordance with Article 6 of the Consumer Protection Law No. 4077, titled "Unfair Terms in the Contract," as amended by Law No. 4822, the membership fee charged by your bank is considered unfair. This is because it is not in return for any service, the term was pre-prepared, included in the standard contract, and could not be negotiated.Additionally, according to the final decision numbered 2011/4736 and 2011/11579 given by the legal department, the annual card fee is retroactively refundable in accordance with Article 125 of the Code of Obligations and the decision numbered 2010/1-93-88 of the general assembly of law. There is also a definitive provision stating that the dues will be refunded.I request that the necessary action be taken to cancel the membership fee of ₺583.00 and refund it to me. I also request that all past membership fees received be refunded. If this issue is not resolved promptly, I will file complaints with the relevant authorities such as the Banking Association and the Consumer Arbitration Committee. I demand that this situation be resolved immediately by your institution.
