Garanti BBVA Charged ₺583 Annual Fee to My Bonus Card Without My Approval
On October 25, 2024, an annual card fee of ₺583 was charged to my Garanti Bank Bonus credit card ending in 2028 without my knowledge or approval. I request the refund of the ₺583 charge and the cancellation of the membership fee based on the following legal provisions without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Protection Law dated May 28, 2014, credit card issuers are required to offer a type of credit card that does not involve annual membership fees or similar charges. Under Article 6 of the Consumer Protection Law No. 4077, amended by Law No. 4822, this membership fee constitutes an unfair term, as it does not correspond to any specific service, was pre-determined, and is included in a standard contract where I had no opportunity to negotiate its terms.
Furthermore, according to the ruling by the 13th Civil Chamber (case no. 2011/4736, decision no. 2011/11579) and HGK decision no. 2010/1-93-88 under Article 125 of the Turkish Code of Obligations, there is a definitive ruling that past annual card fees can also be refunded. Based on these laws and regulations, I request the full cancellation of the membership fee and that this charge be removed from my account today. Otherwise, I will apply to the Consumer Arbitration Committee for a refund of the card fee, and if my dissatisfaction persists, I will proceed with canceling my card and accounts at your bank.
