Beymen Trousers Deformed After One Use - Refund Rejected
On 06 December 2025, I purchased two pairs of Beymen Club trousers from the Beymen Club Metropol AVM store. One of the trousers was worn only once under normal conditions. After a single day of use, the fabric in the knee area stretched, sagged during sitting and standing movements, and failed to return to its original form. Deformation of this nature after only one day of ordinary use constitutes a lack of conformity and is unacceptable for a product of this price level and brand positioning. Both pairs of trousers were washed strictly in accordance with the care instructions stated on the product label: at 30°C, inside out, without the use of a tumble dryer and without applying any process beyond what was specified. Despite full compliance with these instructions, the worn product exhibited permanent deformation at the knees, while the second product has not been worn at all. The products were returned to the Beymen Club Metropol AVM store and sent for inspection. My refund request was rejected following the initial inspection, and upon my objection, the products were subjected to a second inspection. By an email dated 24 December 2025, the Beymen Quality Control Department stated that no manufacturing or quality defect was detected and alleged that the deformation resulted from non-compliance with washing instructions. I do not accept this conclusion. The deformation occurred after only one day of normal use, despite full compliance with the care instructions. Moreover, attributing misuse to an item that has never been worn lacks technical credibility. The inspection report does not specify which care instruction was allegedly violated, nor does it provide any concrete or technical justification supporting the claim of consumer fault. Pursuant to Article 8 of the Turkish Consumer Protection Law No. 6502, goods that fail to conform to the contract at the time of delivery are considered defective. Furthermore, Article 11 of the same Law grants consumers the right to withdraw from the contract and request a full refund in cases of defective goods. Accordingly, as the deformation clearly stems from the defective nature of the products rather than consumer misuse, I hereby exercise my statutory right to withdraw from the contract and request a full refund for both pairs of trousers.
