Tesla Is Refusing To Refund Deposit For An Undelivered Vehicle
Tesla is refusing to refund the deposit for an undelivered vehicle. On November 24, 2024, I placed an order for a Tesla Model Y through Tesla’s official website after seeing that inventory was available. I paid a 140,000 TRY deposit for the order with the order number RN126337935. The delivery date was stated as December 24, 2024, and the vehicle has never been delivered. After placing the order, I discovered that this batch of vehicles has serious equipment deficiencies that were not clearly disclosed at the time of purchase. The car does not even include basic features such as a radio. Due to this incomplete and misleading information, I contacted Tesla by email and requested cancellation of my order and a full refund. Tesla replied in writing that my order was canceled. When I asked about the refund, I was also informed in writing that the payment would be refunded to my card. Despite this, Tesla later issued an invoice labeling the 140,000 TRY as a “processing fee” and then informed me that no refund would be made, claiming that a 14-day period had passed. This is unacceptable, as the vehicle was never delivered, the delivery date had not yet arrived, the sale was never completed, and the cancellation was approved by Tesla itself. Even more concerning, after the cancellation, Tesla contacted me via its mobile app and stated that if I placed a new order and paid another 140,000 TRY, my original 140,000 TRY would be refunded within 14 days. In other words, Tesla made the refund conditional on placing a new order and making another payment, effectively forcing the customer into a “buy it or lose your money” situation. Refusing to refund a deposit for an undelivered vehicle and conditioning the refund on a new purchase is, in my view, unlawful and unethical. All emails, invoices, and in-app messages are documented and available as evidence. I request the immediate and unconditional refund of the 140,000 TRY paid for this undelivered vehicle and state that I will pursue all legal remedies and share the outcome publicly if this issue is not resolved.
When Tesla didn't pay, I applied to the Consumer Arbitration Board and was found to be right. They ordered Tesla to make the payment. I then took the decision and started enforcement. Shortly after starting enforcement, they paid the amount with interest. Then Tesla sued me to cancel the Consumer Arbitration Board's decision and to get the money back.
