Last week, on May 15, 2024, my mother bought me a Fuschia Visco Gel Pillow from B** D*P at their Izmir Karsiyaka branch for ₺1,050 as a gift. She was informed that the pillow was suitable for cervical hernia and that it could be returned if unused. However, upon seeing the pillow, I realized it was not appropriate for cervical hernia and believed my mother had been misled.
Store Manager Ms. D** acknowledged that the pillow was unused but refused to issue a refund. When I attempted to discuss this, she left me and went back to her office. This situation is troubling because of the misleading information provided by the store manager. She should have acknowledged that the pillow was unsuitable for cervical hernia and processed the return.
I reported this to Madame Coco but have yet to receive a response. The product remains unused, and it has only been a week since its purchase. According to Article 48 of the Consumer Protection Law No. 6502, there is a right of withdrawal within 14 days from the date of receipt in distance contracts. Article 11 of the same law provides for the right to return defective goods. It is evident that the product is unused, and thus, I am legally entitled to return it and receive a refund. As a consumer, I have the right to return an unused product, and I demand that this right be recognized.
I am also complaining about the deceptive and profit-driven attitude of B** DP. Following my complaint, I experienced very distressing situations: the day after I reported my issue to the head office, B** DP called me multiple times from a number I had not provided. According to the Personal Data Protection Law No. 6698 (KVKK), my personal information cannot be shared with third parties without my consent. Additionally, as a British citizen, sharing my personal information is a data breach under the Data Protection Act 2018 (UK) and is illegal. My personal information was given to Ms. B** without my consent, and she repeatedly called me, causing significant disturbance. This is a clear violation of customer privacy and personal rights.
I complained about B** D*P again. Unfortunately, I have not received any response to my complaint. Despite informing them that I would be out of town, there has been no reply. I will proceed by taking this matter to the Consumer Court.
