Garanti BBVA Clearly Protected The Scammer And Didn't Do Chargeback

On 13.09.2013, I wanted to make a payment of 4899TL to buy a mobile phone from a scammer. Then I got suspicious and closed the page. However, when I checked my bank account, I saw that 4899TL was debited from my credit card and the transaction was in provision. I immediately called Garanti Bank and asked them to cancel the transaction while it was in provision. However, they said that they could not cancel this transaction, but that I could file an objection after it was reflected on the statement. The objection I made was rejected by Garanti Bank after 2 months. When I asked what evidence the other party presented and how they convinced them, they said they could not answer these questions. I then applied to the Banks Association of Turkey (TBB). TBB also decided that “the objection of the Applicant was not appropriate since the objection process was initiated by the Bank for the transaction subject to the objection of the Applicant and documents were requested from the other bank, the documents shared by the other bank proved that the process of loading money to the wallet was successfully completed and the PRODUCT / SERVICE was DELIVERED.” However, I had submitted documents to both Garanti Bank and the Arbitration Committee of the TBB showing that I had paid money to buy a cell phone, but I did not receive a “your order has been received” message, a cargo tracking number, a phone or any other product/service. In other words, Garanti Bank clearly accepted the documents submitted by the fraudster without question and insistently did not provide me with these documents for my objection or confirmation. They took the same approach to the Arbitration Committee of the TBB and deliberately misled the Arbitration Committee. I say “deliberately” because it was clearly known by Garanti Bank that the incident was a fraud both from the documents I submitted and from the conversations I had on the phone, because the representatives I spoke to said “the product has not been delivered, of course your money will be refunded, don't worry”. In summary, Garanti Bank has victimized me by not performing the chargeback rule even though they should have done so. Therefore, I demand that the amount I have been victimized be paid to me with legal interest starting from 13.09.2023. As a result of the lawsuit I have already filed, in addition to this amount, the other party will have to pay lawyer fees, but I still wanted people to know.
