2025 Volkswagen Caddy Shifts Into Park While Driving

I purchased a brand-new 2025 Volkswagen Caddy on December 18, 2025, from Avek Otomotiv in Istanbul's Tekstilkent district. Despite the car being only about five months old, it has broken down five separate times due to the same recurring issue. Twice I was stranded on the road and had to be towed to the service center; the other three times I managed to drive it in myself.
The core problem is that while driving, the transmission shifts on its own from Drive (D) to Park (P). Because this happens at speed, it risks serious damage to the transmission and, more critically, puts our lives in danger. On top of that, while traveling at roughly 50 mph, the collision avoidance system activates and slams on the brakes on its own — even though the system is switched off — and we have narrowly avoided accidents on multiple occasions because of this. Yet every single time I bring the car in, I'm handed the keys back with the same line: "We ran an update and calibration — there's nothing wrong with your vehicle." The problems never get fixed permanently.
I took out a loan to buy this car and paid off every cent of that debt. In return, I am getting none of the reliability I expected from a brand-new vehicle, and I have lost all confidence in it. To make matters worse, my mother is a Stage 3 CKD patient with both heart failure and kidney failure — there are moments in the middle of the night when I need to rush her to the emergency room. The very real possibility that this car could strand us or slam on the brakes on its own during one of those critical moments is a source of serious, ongoing anxiety for me.
Because no permanent solution has been found despite my repeated complaints, I am now considering legal action. To remedy this situation, I am demanding that the vehicle's defects be formally identified and that the car be replaced — or, if that is not possible, that I be fully reimbursed for what I paid.
