Nissan Juke Airbag Malfunction After 4 Months and No Replacement Despite Legal Rights

On April 29, 2024, I bought a Nissan Juke zero km vehicle from Nissan Gerçek Automotive. The first malfunction of the vehicle occurred on the 20th day. While driving, the temperature gauge rose rapidly. I took it to the service and 2 days later they delivered it with "the faults were cleared and the checks were carried out". After 3 months, it started to give its second malfunction. This time, the airbag malfunction light came on in the vehicle. I immediately called the service and they took my vehicle with a tow truck, stating that it could be dangerous to drive like this. The next day, they cleared the fault codes and delivered the vehicle, but a day later, the Airbag fault light came on again. I took the vehicle back to the service and they got back to me 1 week later. According to the service's statement, they stated that "the front seats and center console of the vehicle must be removed to repair the airbag malfunction." First of all, I would like to ask Nissan Turkey and everyone who reads this article; My vehicle is only 4 months old. Would you prefer such a new vehicle to be subjected to such a repair process for a life-threatening malfunction such as the "Airbag", or would you prefer it to be replaced with a 'New One', which is one of the optional rights granted to me by law? Moreover, Article 10 of the relevant law states that "Defects that appear within six months from the date of delivery are deemed to exist on the date of delivery." The statement is clear and concise. I requested the replacement of the defective vehicle via e-mail along with the petition dated 12.09.2024. After I forwarded the request to the company, they did not call back even though I called them many times. When I reached the company officials on 25.09.2024, again through my own efforts, they stated that they could not respond positively to my request without giving any reason and that I could use my legal rights. In this regard, we have initiated the legal process on September 25, 2024. In such cases, the consumer can continue to use his beekeeper until the court is resolved, but I will not have such an option. Because the vehicle's airbags are not active. How can I trust and use the vehicle with my family? Maybe it will take 2 years and my vehicle will sit in the parking lot for 2 years. The Nissan brand is already over for me, but I suggest those who choose the Nissan brand should think twice. Kind regards.

Yes, a short while ago you responded with "we sold you a car with faulty airbags but we are not replacing them." The reason I wrote here was not to expect a solution from you, but to give a bit of insight about the brand for those who, like me, trust the Nissan brand and consider buying a vehicle. The communication, interest, and attention are quite good until the vehicle is sold, but after the sale, when there is a problem with the vehicle such as "non-working airbags, etc.," I neither see nor hear anything. Until my legal process is concluded, I will continue to raise my voice as much as I can and on every platform I can reach.

Article 10 of the Law No. 6502 on Consumer Protection states, "Defects that appear within six months from the date of delivery are presumed to have existed at the time of delivery."
