Hugo Boss Sunglasses Arrived Scratched, Store Refused Replacement

I purchased Hugo Boss sunglasses (model 1042/S/IT 80790, serial 56-14 145) on April 17, 2024, from Metrogarden Opmar Optik. Today, when I took them out of the case for the first time, I noticed scratches on both lenses. Despite never using the sunglasses, the store refused my request for a return or exchange, claiming the issue would likely be considered "customer error" by the brand.
I find this response unacceptable. The glasses were brand new and untouched until today. I expect Hugo Boss to take responsibility for delivering a defective product. If this issue is not resolved promptly, I will escalate the matter to the Consumer Rights Court. I request immediate support to replace or refund this product.
