Axess Credit Card Charged Unauthorized Membership Fee Without Consent

On November 8, 2025, an amount of ₺1,149.50 was charged to my Axess credit card ending in 8826 under the description of a membership fee without my knowledge or consent, and it was reflected on my statement. I request a full refund of this amount as well as all previously charged membership fees. I also demand that these membership fees be canceled without any additional conditions, in accordance with the legal provisions outlined below. According to Article 31, Paragraph 3 of the Consumer Protection Law dated May 28, 2014, credit card issuers are required to offer a credit card type that does not charge an annual membership or similar fee. Furthermore, under Article 6 of the Law No. 4077 on Consumer Protection, as amended by Law No. 4822, any membership fee charged by your bank constitutes an unfair term, as it provides no service in return and was pre-drafted without room for negotiation. Additionally, the 13th Civil Chamber’s final ruling (2011/4736 E., 2011/11579 K.) confirms that both current and retroactively charged card fees must be refunded. Based on these laws and rulings, I request that the membership fees charged to me be refunded immediately, and that the current membership fee be canceled and returned today. Otherwise, I will file a complaint with the Consumer Arbitration Committee for a refund of the fee and, if my dissatisfaction continues, apply to your bank for the cancellation of my card and accounts. I kindly request that the necessary action be taken on this matter.
