Akbank Charged Me a Card Fee Without My Consent
This is my request for a refund of the membership fee charged to my Akbank Axess credit card. On 08/07/2025, an amount of 1,149.50₺ was deducted from my card ending in 9931 without my knowledge or consent under the name of a membership fee. I request that this fee be canceled and refunded to me without any additional conditions, in accordance with the relevant legal regulations stated below. According to Article 31, Paragraph 3 of the Consumer Protection Law dated May 28, 2014, card issuers are required to offer a credit card option that does not charge an annual membership fee or any similar charges. Pursuant to Article 6 of the Law on Consumer Protection No. 4077, amended by Law No. 4822, the membership fee charged by your bank is considered an unfair term, as it does not correspond to any actual service, is pre-drafted, and included in standard agreements without allowing negotiation. Additionally, according to the final ruling by the 13th Civil Chamber of the Court of Appeals, case number 2011/4736 and decision number 2011/11579, and in line with Article 125 of the Turkish Code of Obligations and Supreme Court General Assembly decision 2010/1-93-88, it has been definitively ruled that even retroactively charged card fees must be refunded. Based on these laws and legal precedents, I request the cancellation and refund of the membership fee. Otherwise, I will apply to the Consumer Arbitration Committee and, if my dissatisfaction is not resolved, I will request the closure of my card and accounts with your bank.
