Akbank Charged Me Membership Fee on My Axess Credit Card Without Service
I request the cancellation and refund of the ₺1,149.50 membership fee charged to my Akbank Axess Credit Card ending in 1777 on 01.03.2025, in accordance with the relevant legal provisions and without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, card-issuing institutions are required to offer a credit card type that does not charge an annual membership fee or similar fees to consumers. Under Article 6 of the Law on the Protection of Consumers No. 4077, as amended by Law No. 4822, the membership fee charged by your bank constitutes an unfair term, as it is not provided in exchange for any service, is a pre-prepared contract term, and was not subject to negotiation, especially as it is part of a standard contract. The final decision of the 13th Civil Chamber, numbered 2011/4736 and 2011/11579, also establishes that the annual card fee, including retroactively charged fees, must be refunded in accordance with Article 125 of the Turkish Code of Obligations and the 2010/1-93-88 decision of the General Assembly of Civil Chambers. I request the necessary action to refund the ₺1,016 membership fee I paid, along with any applicable interest, and to ensure the cancellation and refund of the membership fee. Otherwise, I will file a complaint with relevant authorities such as the Banks Association and the Consumer Arbitration Committee. I would also like to state that I will cancel my card if this issue is not resolved. I respectfully request that this matter be addressed and resolved.
