I Was Charged a Membership Fee on My Gold Card Without Consent by Akbank
I request the cancellation and refund of the ₺1,016.00 membership fee charged to my Axess Gold credit card ending in 2482 on 02.03.2025, in accordance with the legal provisions stated below and without being subject to any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, card-issuing institutions are required to offer consumers a credit card option that does not charge an annual membership fee or any similar fees. Additionally, under Article 6 of the Law on the Protection of Consumers No. 4077, amended by Law No. 4822, the membership fee charged by your bank is deemed an unfair term, as it does not correspond to any specific service, is pre-determined, and cannot be negotiated. Furthermore, according to the final rulings of the 13th Civil Chamber of the Court of Cassation (2011/4736 E, 2011/11579 K) and the General Assembly of Civil Chambers (2010/1-93-88), retroactive refunds of card fees are also legally mandated. For these reasons, I kindly request that the ₺1,016.00 membership fee be refunded and the issue resolved promptly. Otherwise, I will file complaints with relevant authorities such as the Banking Association and the Consumer Arbitration Committee.
