Yapi Kredi Bank Charges Unauthorized Annual Card Fee

I was charged 356 TL as an annual card fee for my Yapı Kredi Word credit card ending in 7548. According to the Consumer Law (28 May 2014, Article 31, Paragraph 3), card issuers are obligated to offer a credit card type without imposing an annual membership fee or any similar charge. Therefore, I demand the immediate cancellation of these fees without any additional conditions. Based on the Law No. 4822, Amendment to the Law No. 4077 on Consumer Protection, Article 6 regarding unfair contract terms, your membership fee does not correspond to any service, making it an unfair term as it was not negotiated individually and presented in a pre-prepared standard contract. Referring to the decision of the 13th Civil Chamber, File No. 2011/4736, Verdict No. 2011/11579, I request not only the cancellation of the annual card fee but also the reimbursement of any previously charged fees in compliance with Article 125 of the Turkish Code of Obligations and HGK decision 2010/1-93-88. I kindly urge you to take the necessary actions for the refund of the unjustly collected fees, including the cancellation of the membership fee within the same day. Failure to address my concern may lead to my application to the Consumer Arbitration Board or the cancellation of my account and card if necessary. Your prompt attention is appreciated.
