Akbank Unauthorized Annual Fee Charge - Request for Refund

On January 19, 2024, an unauthorized membership fee of ₺796.50 was charged to my Akbank credit card ending in 8861 without my knowledge or consent. I demand the refund of this amount and the cancellation of the fee based on the legal provisions outlined below, without any additional conditions.
According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, card-issuing institutions must offer a type of credit card that does not charge annual membership fees or similar charges to consumers. Furthermore, under Article 6 of the Law on the Protection of Consumers No. 4077, amended by Law No. 4822, the membership fee your bank charges is considered an unfair term since it is not in exchange for any service. This clause in the contract is pre-prepared and cannot be negotiated, making it an unfair condition.
According to the final ruling of the 13th Civil Chamber, numbered 2011/4736 and 2011/11579, there is a definitive ruling stating that annual card fees must be refunded retroactively in accordance with Article 125 of the Code of Obligations and the decision of the Supreme Court of Appeals No. 2010/1-93-88.
Based on this law and these legal provisions, I request that the entire membership fee be canceled and that the fee be refunded to me within the day. Otherwise, I will inform the Consumer Arbitration Committee about the refund of the card fee and, if my dissatisfaction persists, I will apply to your bank for the cancellation of my card and accounts.
