Akbank Membership Fee Refund Request

On June 14, 2024, a membership fee of ₺796.50 was charged to my Akbank credit card ending in 8745. I request the cancellation of this fee as per the following legal provisions without any additional conditions:

"Consumer Law, May 28, 2014, Article 31, Clause 3: Card-issuing organizations are required to offer a type of credit card to consumers that does not charge an annual membership fee or any similar charges. According to Article 6 of the Consumer Protection Law No. 4077, amended by Law No. 4822, the membership fee charged by your bank is considered an unfair term in the contract as it does not correspond to any service provided, and the contract terms are predetermined and non-negotiable."

Furthermore, according to the final decision of the 13th Civil Chamber (2011/4736 principal, 2011/11579 decision) and Article 125 of the Turkish Code of Obligations (BK) (2010/1-93-88 decision of the General Assembly of the Court of Cassation), the annual card fees charged retroactively must also be refunded. If this issue is not resolved, I will take this matter to the Consumer Rights Court.
