Akbank Refused to Refund the Membership Fee on My Gold MC Card
I request the cancellation and refund of the ₺704 membership fee charged on November 8, 2024, to my Akbank Gold MC card ending in 7543, based on the legal provisions below and without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law of May 28, 2014, card-issuing institutions must offer a type of credit card to consumers that does not charge an annual membership fee or similar charges. Under Article 6 of the Law on the Protection of the Consumer No. 4077, as amended by Law No. 4822, titled "unfair terms in contracts," the membership fee charged by your bank is deemed an unfair term, as it does not correspond to any service, is pre-determined, and could not be negotiated, especially as it is included in the standard contract. Based on the final decision by the 13th Civil Chamber, 2011/4736 E., 2011/11579 K., and the ruling HGK 2010/1-93-88, there is a definitive provision for the reimbursement of retroactively deducted card fees. Therefore, I request the cancellation and refund of the ₺704 membership fee, along with any applicable interest. Otherwise, I will file complaints with relevant authorities, such as the Banks Association and the Consumer Arbitration Committee. Additionally, I would like to state that I will cancel my card if this issue is not resolved. I respectfully request that this matter be resolved.
