Honda Civic Transmission Failure And Claim For Refund Of Repair Costs



Dear Sir/Madam, I am the owner of a 2019 Honda Civic 1.6 Automatic (VIN: NLAFC5659JW119861, License Plate: 34 CES 581). On September 10, 2025, while driving on the Düzce highway in Turkey, my vehicle suffered a critical transmission failure – the transmission chain broke – leaving the car stranded. This vehicle was purchased from Honda Marmara in Turkey and all periodic maintenance services were performed at Honda Marmara Authorized Service. Despite this, such a major failure in a core component like the transmission occurring within this time frame is highly abnormal and clearly constitutes a hidden defect (“latent defect”) under the Turkish Consumer Protection Law No. 6502. The repair of my vehicle’s transmission was carried out by RS Oto Hadımköy (YKM Otomotiv), for which I was charged ₺119,200. A copy of the official service work order closure document (stamped and signed “payment received”) is attached. Additionally, I am providing the payment receipt, photos and videos showing the failure before repair, and full maintenance records from Honda Marmara Authorized Service. Please note that the expiration of the warranty period does not remove the responsibility of the manufacturer/importer/seller in cases of hidden defects caused by manufacturing faults. The Turkish Supreme Court of Appeals (Yargıtay) has repeatedly ruled in favor of consumers in similar cases. Accordingly, I formally demand the reimbursement of the ₺119,200 repair cost. Unless this payment is made within 7 days of receipt of this notice, I will initiate legal proceedings before the Consumer Arbitration Committee and/or Consumer Court in Turkey. I will also hold Honda responsible for all legal costs, accrued interest, and attorney’s fees arising from such proceedings. This email is also being sent to Honda Motor Co. Ltd.
