We own an apartment on the 6th floor of a six-story building, with the title deed registered in my wife's name. Our downstairs neighbor has damage insurance through Allianz Sigorta, which is perfectly normal. Both of us have rear balconies, but with one difference: my neighbor's balcony is open on three sides, while mine is fully enclosed with PVC windows and integrated into the living space. The entire area, including the balcony, is covered with laminate flooring, and there is no water installation in the living room or balcony.
Because my neighbor's balcony is open on three sides, natural weather conditions cause paint to peel and plaster to deteriorate every few years, as is common with open balconies. However, every time this happens, my neighbor claims that water is leaking from the upstairs apartment and calls an expert from your company. Despite there being no evidence of water leakage, such as swelling or damage to my laminate flooring, the expert repeatedly concludes that the damage is caused by leakage from my apartment, assigning the liability to me.
The aim here seems to be avoiding inconvenience for the insured while ensuring the insurance company doesn’t pay the claim, instead transferring the cost to a third party. I ended up paying the ₺3,130 recourse amount, which is fine. However, at the beginning of this issue, I also took out an insurance policy. My sole condition was to cover complaints about water leakage to the downstairs balcony, stating that I would handle any other damages myself. The reason for my complaint is the lack of any documentation or proof provided by the expert to support the claim of water leakage from my apartment. Despite this, I received an SMS stating I had to pay ₺3,130 within seven days or face legal action. I reported my complaint to Allianz's website and requested a callback. They called briefly the next day and hung up, likely intending to claim they tried to contact me, but I didn’t answer. In summary, I request that damage reports filed for exploitative purposes be thoroughly investigated and that your experts handle such matters with greater diligence. I believe the insured party, the expert, and the insurance company acted unfairly in my case.
