I Cannot Withdraw My Mothers Pension Despite Court Order
I was appointed as the legal guardian of my mother, Z***** U***, by the Turgutlu 2nd Civil Court of Peace. Subsequently, the same court authorized me with an additional decision to withdraw her pension, bank promotion payments, and holiday bonuses from her account at Türkiye İş Bankası’s Turgutlu/Manisa branch. I went to the relevant branch and presented the court rulings in order to access the funds. However, the bank shockingly disregarded the official court decisions and refused to make the payment, acting as if it were above the law. Their excuse was that they hadn’t received the decision and were waiting for confirmation from headquarters. When I spoke with the court about this, they clarified that the court does not directly send decisions to banks and that the bank is obligated to make the payment once the original ruling is submitted. Unfortunately, I cannot attach the court documents here due to sensitive personal information (ID number, address, place and date of birth, etc.), but I can provide them upon request. If this issue is not resolved, I will pursue all necessary legal avenues to defend our rights.
I reported the relevant bank branch to the BDDK via CİMER. Four days after my complaint, with the intervention of the BDDK, the bank branch made the payments to me. So it was possible after all. So court decisions cannot just be ignored. Almost all of the employees working in the individual section of this bank branch create more problems instead of solving people's issues. And again, almost all the staff in this section are not fully competent in their jobs. They act very irresponsibly. It's a shame, really a shame. In fact, they should be a solution, not a problem.
