Garanti BBVA Credit Card Annual Fee Cancellation Request

On March 19, 2024, an annual card fee of ₺583.00 was charged to my Garanti Bonus Trink credit card ending in 5549********4316. I request the cancellation of the annual card fee in accordance with the provisions of the law and without any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law No. 6502 dated May 28, 2014, card issuers are obliged to provide consumers with a credit card type that does not charge an annual membership fee or similar fees. Furthermore, according to Article 6 of Law No. 4077 on Consumer Protection, amended by Law No. 4822, the membership fee charged by your bank does not represent any service, is predetermined, and cannot be negotiated, making it an unfair term. Additionally, based on the final judgment of the 13th Civil Chamber with file number 2011/4736 and decision number 2011/11579, there is a definite ruling that annual card membership fees, as well as retroactively charged card fees, must be refunded according to Article 125 of the Turkish Code of Obligations and the decision of the General Assembly of Civil Chambers numbered 2010/1-93-88. I demand the refund of the annual card fees. Otherwise, I will resort to legal action and declare that I will cancel all my accounts and credit cards with your bank.
