Trendyol Does Not Accept Returns Of Electronic Products Even If Unused

Trendyol Does Not Accept Returns of Electronic Products Even If Unused On June 16, 2024, I purchased a Braun "Multiquick 7 Hand Blender Mq7025x" food processor from the seller Sirin Hane on the Trendyol shopping site for 3149 TL. The product was delivered quickly. However, I did not like the quality of the product, so I initiated a return process without using it at all. On June 29, 2024, my return request was rejected. I contacted Trendyol live support to inquire about the reason for the rejection. They informed me that returns are not accepted for electronic products once the box is opened. The product is not sold with any seal or wrapping like a band or shrink wrap. There is no damage to the box or the product. The product was not used even once for trial purposes. Article 15 of the Consumer Protection Law No. 6502 regulates the scope and conditions of the right of withdrawal for consumers in e-commerce purchases. With the amendments made to the law, the return period for e-commerce purchases has been set as 14 days. I spoke with Trendyol phone support again. They reiterated that my return would not be accepted as the product is considered second-hand and that returns are not accepted for sealed products. I spoke with the Braun brand's customer service. They stated that if I had purchased the product from the Braun website, they would have accepted the return under Consumer Rights. However, since I did not purchase from their website, the return could only be processed through Trendyol. I am complaining about the seller Şirin Hane, owned by M. Y., and the Trendyol shopping site for violating my right of withdrawal under consumer rights. I have submitted my application to the Consumer Arbitration Committee. I expect the necessary investigations to be conducted and my return right to be activated.
As a result of my application to the Consumer Arbitration Board, I was found to be in the right. The seller had to take back the product by covering all court expenses.
