Identify the legal grounds for a refund.
A refund is possible not only due to a “change of mind,” but also in cases of:
serious vehicle defects
recurring malfunctions
excessively long warranty repairs
non-compliance with the stated specifications
These grounds must be clearly identified and documented.
Check how the refusal was issued.
If the dealer refused verbally, it does not count. Request a written refusal stating the reasons. Without an official refusal, further action becomes more difficult.
Collect all documentation.
Prepare the sales contract, delivery and acceptance reports, service orders, warranty claims, correspondence, and evidence of defects. This documentation is the foundation of any formal claim.
Submit a written claim to the seller.
In the claim, clearly state:
what exactly the violation is
the legal grounds for requesting a refund
a specific demand — a full refund of the purchase price
The wording must be clear and unambiguous.
Do not agree to a replacement or repair if you are demanding a refund.
If you have formally requested a refund, the seller has no right to impose other options without your consent.
If Skywell has refused to refund your money, make sure to file a complaint on Xolvie and formally document the violation.
