I Was Charged an Annual Fee on My Maximiles Black Card by İş Bankası

A charge of ₺1,758.00 for the annual membership fee and ₺87.90 for BSMV has been applied to my Türkiye İş Bankası Maximiles Black card ending in 3420. I request the immediate cancellation and refund of this total amount of ₺1,845.90. According to the relevant legal provisions stated below, I demand a full refund of the annual fee without any additional conditions. As per Article 31, Paragraph 3 of the Consumer Protection Law No. 6502 dated May 28, 2014, credit card issuers are required to offer a card type that does not incur annual fees or similar charges. Additionally, according to Article 6 of the Law on the Protection of Consumers No. 4077, amended by Law No. 4822, such fees are considered unfair terms since they are pre-drafted and non-negotiable, and not in exchange for any specific service. The 13th Civil Chamber of the Court of Cassation's decision numbered 2011/4736 and 2011/11579, along with the General Assembly of Civil Chambers’ ruling 2010/1-93-88, also confirms that card fees charged retroactively must be refunded in accordance with Article 125 of the Code of Obligations. Based on these legal grounds, I request that the annual fee be canceled and refunded to me. Otherwise, I will file a complaint with the Consumer Arbitration Board and proceed to close all my cards and accounts with your bank.
