I Want My Annual Credit Card Fee Refunded for No Service from Garanti BBVA
I request the cancellation and refund of the ₺841.50 annual credit card membership fee charged to my Garanti BBVA credit card on May 17, 2025. According to Article 31, Paragraph 3 of the Turkish Consumer Protection Law No. 6502, dated May 28, 2014, card issuers are required to offer a credit card option that does not charge an annual membership fee or similar charges. Furthermore, based on Article 6 of Law No. 4077 on the Protection of Consumers, as amended by Law No. 4822, such membership fees—being unilaterally determined and part of a standard contract—are deemed unfair terms, as they are not subject to negotiation and are not in exchange for any service. Additionally, a ruling by the 13th Civil Chamber (2011/4736 E, 2011/11579 K) and the General Assembly of Civil Chambers (2010/1-93-88) confirm that retroactively charged annual fees must also be refunded under Article 125 of the Turkish Code of Obligations. Based on these legal grounds, I kindly request the immediate cancellation and refund of the membership fee, as well as a written confirmation sent to my email address. Otherwise, I will file a complaint with the Consumer Arbitration Committee and, if necessary, request the cancellation of my credit card and accounts with your bank.
