I Request a Refund for the Annual Fee on My Maximum Card

A total fee of ₺553.88 was charged to my personal Maximum Visa credit card ending in 8662 on 15.06.2025, consisting of a ₺527.50 annual credit card fee and ₺26.38 BSMV. According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, institutions that issue credit cards are required to offer a card that does not charge an annual membership fee or similar charges. As per Article 6 of Law No. 4077 on Consumer Protection, amended by Law No. 4822, the membership fee charged by your bank constitutes an unfair term in the contract, as it is pre-drafted, included in a standard contract, and not subject to negotiation. Based on the ruling of the 13th Civil Chamber, decision number 2011/4736 and 2011/11579, and the General Assembly of the Supreme Court (HGK) decision 2010/1-93-88, there is a definitive legal precedent for the refund of retroactively charged card fees. Therefore, relying on the clear provisions in Turkish legislation, I request a full refund of the annual card fee charged under terms such as card membership or annual fee. I do not accept being subjected to an extra financial burden and expect the fee to be canceled and refunded. If I do not receive a response, I will stop using your bank entirely, for both investment and shopping purposes. I will submit a complaint to the Banks Association of Turkey and the Consumer Arbitration Board, and I will cancel all my actively used credit cards.
