As per Article 6 of Law No. 4077 on Consumer Protection, amended by Law No. 4822, the membership fee charged by your bank constitutes an unfair term in the contract, as it is pre-drafted, included in a standard contract, and not subject to negotiation. Based on the ruling of the 13th Civil Chamber, decision number 2011/4736 and 2011/11579, and the General Assembly of the Supreme Court (HGK) decision 2010/1-93-88, there is a definitive legal precedent for the refund of retroactively charged card fees. Therefore, relying on the clear provisions in Turkish legislation, I request a full refund of the annual card fee charged under terms such as card membership or annual fee. I do not accept being subjected to an extra financial burden and expect the fee to be canceled and refunded. If I do not receive a response, I will stop using your bank entirely, for both investment and shopping purposes. I will submit a complaint to the Banks Association of Turkey and the Consumer Arbitration Board, and I will cancel all my actively used credit cards.
