Garanti BBVA Credit Card Charged with Annual Card Fee Against Legal Provisions
On 26.07.2024, an annual card fee of 678.50 TL was reflected on my Bonus Gold credit card ending in 0021 belonging to Garanti BBVA. I request that the membership fee be canceled in accordance with the legal provisions specified below and without any additional conditions. 'According to the 3rd paragraph of Article 31 of the Consumer Law dated 28 May 2014, card issuing institutions are obliged to offer consumers a type of credit card for which they do not collect annual membership fees or similar fees. In accordance with Article 6 titled unfair terms in contracts of the Consumer Protection Law No. 4077 as amended by Law No. 4822, the membership fee that your bank is charging is not in return for any service, since the contract term in question is prepared in advance and its content cannot be influenced or negotiated, it is an unfair term, especially since it is included in the standard contract. '13. According to the final decision numbered 2011/4736 and main decision numbered 2011/11579 given by the Law Department, there is a definitive provision that the annual card fee fee in question will also be refunded in accordance with Article 125 of the Code of Obligations and the decision numbered 2010/1-93-88 of the General Assembly of Law.' I request that the necessary be done regarding the refund of the fee fees received. Otherwise, I state that I will take legal action and I hereby declare that I will cancel all my accounts and all my credit cards with your bank.
