Under the name of Garanti Bonus, an amount of 583 TL was withdrawn from my Garanti Bank credit card ending with the last four digits 8012 on March 29, 2024, as an annual card fee without my knowledge. I request the cancellation of the card fee in accordance with the legal provisions stated below and without any additional conditions. According to the 3rd Paragraph of the 31st Article of the Consumer Law dated May 28, 2014, card-issuing institutions are required to offer a type of credit card to consumers for which they do not charge an annual membership fee or similar fees. In accordance with Article 6 titled 'unfair terms in contracts' of the Law on Consumer Protection No. 4077, as amended by Law No. 4822, the membership fee charged by your bank is an unfair term as it is not in return for any service, and since the said contract term was pre-prepared, especially included in the standard contract, it was not negotiated and its content was not influenced. According to the final decision of the 13th Civil Chamber, numbered 2011/4736 and 2011/11579, there is a definitive provision that the annual card fee in question will be refunded retroactively in accordance with Article 125 of the Code of Obligations and the decision of the General Assembly of the Civil Chambers numbered 2010/1-93-88. Otherwise, I declare that I will initiate the legal process and apply to legal remedies and the Consumer Arbitration Committee. In the interest of customer satisfaction, I kindly request the cancellation of the 583 TL reflected on my credit card and to be informed accordingly.
