As a salary customer of Akbank, I was charged a ₺1,149.50 annual credit card membership fee on April 20, 2025, for my Axess Platinum credit card ending in 0917. During my call with customer service, I was told that only around ₺575 of this fee could be refunded as Chip Para, while the remaining amount would not be refunded. I request the full cancellation of this fee and a complete refund based on the legal provisions I outline below, without being subject to any additional conditions. According to Article 31, Paragraph 3 of the Consumer Law dated May 28, 2014, card issuers must offer a credit card option that does not charge an annual fee or similar. Per Article 6 of the Consumer Protection Law No. 4077, amended by Law No. 4822, the membership fee charged by your bank is considered an unfair term, as it is not in exchange for any specific service and is pre-drafted in a standard contract with no room for negotiation. The 13th Civil Chamber’s ruling (2011/4736 E., 2011/11579 K.) also confirms that such fees are to be refunded retroactively under Article 125 of the Code of Obligations and the Supreme Court’s ruling (HGK 2010/1-93-88). Therefore, I request the immediate cancellation and refund of the ₺1,149.50 membership fee. I also inform you that I will file a complaint with the Consumer Arbitration Board and cancel my credit card if this issue is not resolved. I kindly ask that the necessary action be taken.
